DMCA notice & takedown policy
C.L.E.A.N.® Food Certified (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the C.L.E.A.N.® Food Certified application and platform (the “App”) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512, “DMCA”), we will respond expeditiously to claims of copyright infringement involving user-uploaded content (including product photos, packaging images, and ingredient labels) hosted on or transmitted through our App, provided such claims are reported to our Designated Copyright Agent identified below.
1. Notice of claimed infringement (take-down notice)
If you are a copyright owner, or authorized to act on behalf of one, and you believe in good faith that any content, photo, or image hosted on the App infringes upon your copyright, please submit a written notification to our Designated Copyright Agent containing the following information:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., direct URLs or specific barcode/product page identifiers within the App).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (e.g., “I have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law”).
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Procedures upon receipt of a notice
Upon receipt of a valid and complete DMCA Notice containing the items outlined above:
- We will remove or disable access to the allegedly infringing material expeditiously.
- We will take reasonable steps to notify the user who uploaded the material (“Subscriber”) that we have removed or disabled access to the material.
- Repeat infringers: In accordance with the DMCA and other applicable laws, C.L.E.A.N.® Food Certified has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
4. Counter-notification procedures
If a user or subscriber believes that content removed or disabled by mistake or misidentification was not infringing, they may submit a written Counter-Notification to our Designated Copyright Agent. To be effective, the Counter-Notification must include:
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The subscriber’s name, address, telephone number, and email address.
- A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if outside the United States, for any judicial district in which C.L.E.A.N.® Food Certified may be found), and that the subscriber will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
- The physical or electronic signature of the subscriber.
If a valid Counter-Notification is received, we may send a copy of the Counter-Notification to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider or user, the removed material may be restored in 10 to 14 business days or more after receipt of the Counter-Notification, at our sole discretion.
